Briefing on Workshop on IPR Border Enforcement Measures in Ankara (14-15 April) under Activity 3

A workshop on IPR Border Enforcement Measures was conducted in Ankara at the General Directorate of Customs on April 14-15th. The workshop aimed at proposing and explaining a balanced legal text to the Turkish Customs Administration as a draft for the future amendments of the current legal Customs IPR enforcement legal framework.

It aims to raise awareness of the Project’s objectives and upcoming activities in Turkey and to facilitate the introduction of the MS key experts to their respective BC counterparts and other external players and internal stakeholders.

Activity 1. To review the existing customs legislation on IPR of Turkey and EU

Legislation will be analysed in order to eliminate any implementation differences between EU and Turkish Customs legislation in respect of border enforcement of IPR. The activity will consist of reviewing the Turkish Customs law No. 4458 in the light of EU acquis and provide tables of concordance with the EU Regulation 608/2013. With the amendments to the Turkish Customs Law No.

Activity 2. To conduct a gap and needs analysis

A “gaps analysis” will be carried out and a report will be drafted. A roundtable discussion will take place bringing key stakeholders together to ensure all necessary views are heard and to increase commitment and ownership.

It will consist of thematic review of the main gaps (compulsory destruction of goods, small consignments, procedural issues, cooperation/exchange of information).

Activity 3. To draft new national provisions concerning the border enforcement of IPR

The necessary legislative amendments shall be drafted. At a final stage MS experts will organise a workshop with their Turkish homologues where all proposed amendments would be discussed in detail.

The workshop will have the same structure as the roundtable on the identification of the legislative gaps, i.e. thematic review of 4 key issues (compulsory destruction of infringing goods, small consignments, procedural issues, cooperation/exchange of information).

Activity 4. Study visits to EU Member States to observe EU best practices (including software programmes related to IPR)

Study visits to EU Member States to observe EU best practices (including software programmes related to IPR) for total of 16 Turkish Customs officers will be organised in Greece and Italy. The EU MS states selected are operating in the same dispersed geographical environment and the study visits will encourage cross-border cooperation even after the completion of the project.

Closure Conference

To publicize and disseminate the achievements of the Project, presenting to a broader audience the obtained results and the associated conclusions. Representatives from involved MS Partner Institutions, Beneficiary Institutions, Government Institutions, the European Union and the press will be invited to attend.
